BOSS AI Terms of Service

Effective 28 October 2026

Important: clinical decision support only

BOSS AI estimates post-operative refraction from the measurements you enter. Its predictions can be wrong and are not a diagnosis or a treatment plan. They are for licensed eye-care professionals, as one input alongside their own clinical judgment, the patient's full examination and the laser manufacturer's planning. The treating surgeon remains solely responsible for every treatment decision. BOSS AI has not been cleared or approved by the U.S. Food and Drug Administration or any other regulator.

1. These terms

These Terms of Service ("Terms") govern use of BOSS AI (the "Service"), provided by Intelon Optics, Inc. ("Intelon", "we"). By creating an account or using the Service you accept these Terms. If you sign up a clinic, you accept them for that clinic (the "Clinic") and confirm that you are authorised to do so; each person the Clinic adds accepts them for their own use.

If the Clinic has a separate signed agreement with Intelon (such as an order form, pilot agreement or Business Associate Agreement), that agreement prevails where it conflicts with these Terms.

2. The Service and its intended use

BOSS AI predicts post-operative manifest refraction spherical equivalent for corneal refractive surgery from pre-operative measurements, and lets clinics record actual outcomes, which are used to improve the prediction models. It is intended for use only by licensed ophthalmologists, optometrists and their supervised clinical staff, in a clinical practice.

The Service does not control, program or communicate with any surgical laser or other device. It is not intended for emergencies or for use by patients.

3. Medical disclaimer

Predictions are statistical estimates based on past cases and on the data you enter. They may be inaccurate for an individual patient, especially for measurements outside the ranges the models were built on, for devices or procedures with few recorded outcomes, or when data are entered incorrectly.

The Service does not provide medical advice and does not replace professional judgment. You must check every prediction against the patient's full clinical picture and the laser manufacturer's own planning, and you must not rely on the Service as the sole basis for any treatment decision. The treating surgeon and the Clinic are solely responsible for patient selection, treatment planning, consent and outcomes.

4. Accounts and security

  • Each person must have their own account. Do not share sign-in details.
  • Keep your password confidential and tell us promptly at ykim@intelon.com if you suspect unauthorised use.
  • Clinic administrators are responsible for who has access to the Clinic's account, for choosing the right roles, and for deactivating people who leave.
  • Sessions end automatically after a period of inactivity; sign out on shared computers.

5. Patient data and privacy

The Clinic decides what patient data to enter and is responsible for having the right to do so, including any notices to or consents from patients that the law requires.

Where the U.S. Health Insurance Portability and Accountability Act (HIPAA) applies, the Clinic must sign a Business Associate Agreement ("BAA") with Intelon before entering protected health information. Clinics outside the United States must have an equivalent data processing agreement in place under their local law (for example the EU General Data Protection Regulation or the Korean Personal Information Protection Act).

Enter only the data the Service needs. Use the Clinic's chart or record numbers as patient identifiers, and do not enter patient names, contact details or other direct identifiers in any field, note or file name.

Other clinics never see the Clinic's patients or results. The Clinic's own AI model is trained only on its results and used only by the Clinic. As permitted by the BAA or data processing agreement, Intelon also uses recorded measurements and results, without patient identifiers or notes, to train and evaluate the global models shared by all clinics. Intelon processes patient data only to provide, secure, support and improve the Service, and as the law requires.

6. Acceptable use

You must not:

  • use the Service unlawfully, or in breach of patient confidentiality;
  • try to access data of another clinic, or any part of the Service you are not authorised to use;
  • probe, scan or test the Service's security without our written permission (report vulnerabilities to ykim@intelon.com);
  • copy, reverse engineer or extract the prediction models, or use the Service to build a competing product;
  • overload or disrupt the Service, or access it by automated means other than features we provide;
  • upload malicious code, or data you know to be false.

We may suspend access that breaches these rules or puts patients, other clinics or the Service at risk.

7. Ownership

Intelon owns the Service, its software, the prediction models and their coefficients, and all improvements to them. These Terms give the Clinic a non-exclusive, non-transferable right to use the Service for its own clinical practice while its account is active.

The Clinic keeps its rights in the data it enters, and gives Intelon the rights needed to use that data as described in section 5. If you send us suggestions or feedback, we may use them freely.

8. Fees

Fees, if any, are set out in the Clinic's order form or separate agreement. Pilot or trial access may be changed or ended as described in that agreement.

9. Availability and changes

We aim to keep the Service available and secure but do not guarantee that it will be uninterrupted or error-free. We may update the Service, including its prediction models, at any time; model releases are checked before they reach clinics. Keep your own clinical records: the Service is not a medical record system.

10. Disclaimer of warranties

To the extent permitted by law, the Service and all predictions are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the extent permitted by law, Intelon is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data, or for any clinical outcome, arising from use of the Service. Intelon's total liability for all claims relating to the Service is limited to the fees the Clinic paid for the Service in the twelve months before the claim arose, or one hundred U.S. dollars if no fees were paid.

Nothing in these Terms limits liability that cannot be limited by law, or Intelon's obligations under a signed BAA or data processing agreement.

12. Responsibility for clinical use

The Clinic will defend and indemnify Intelon against third-party claims arising from treatment decisions made by the Clinic or its staff, from data the Clinic entered without the right to do so, or from the Clinic's breach of these Terms.

13. Ending use

The Clinic may stop using the Service at any time. We may end or suspend an account for breach of these Terms, or end the Service with reasonable notice. On request when an account ends, we will provide the Clinic's data in CSV form and then return or delete patient data as the BAA or data processing agreement and the law require. Sections 3, 5, 7 and 10 to 14 continue after the account ends.

14. Changes to these Terms; contact

We may update these Terms. We will show the new version in the Service, and you will be asked to accept it before continuing. If you do not accept, stop using the Service and contact us.

These Terms are governed by the laws named in the Clinic's signed agreement with Intelon or, where there is none, the laws of the place where Intelon Optics, Inc. is incorporated. Questions about these Terms: ykim@intelon.com.
